Important Notice FairBillUSA is an independent medical bill assistance service. We are not a law firm, healthcare provider, insurance company, collection agency, credit repair organization, or government agency. We do not provide legal, medical, tax, insurance, or financial advice.

1. Acceptance of These Terms

These Terms of Service govern your access to and use of the FairBillUSA website, forms, consultations, communications, and medical bill assistance services.

By using our website, submitting an eligibility form, scheduling a consultation, communicating with us, or using our services, you agree to these Terms.

Submitting an eligibility form or participating in a free consultation does not require you to purchase our services. Paid services begin only after you review and accept a separate written service agreement.

2. Our Services

FairBillUSA helps individuals identify and apply for hospital financial assistance, charity care, hardship discounts, or similar patient assistance programs for which they may qualify.

Our services may include:

  • Reviewing information about your medical bill;
  • Researching available financial assistance programs;
  • Helping you gather required documents;
  • Preparing or assisting with applications;
  • Submitting documents with your authorization;
  • Communicating with hospitals regarding your application; and
  • Providing updates about your case.

The exact services provided will be described in your written service agreement.

3. Eligibility and No Guarantee of Results

Each hospital or assistance program sets its own eligibility requirements, deadlines, documentation rules, and approval process.

Eligibility may depend on household income, family size, insurance status, residency, the type of medical care received, and the hospital's policies.

FairBillUSA cannot guarantee that:

  • You will qualify for assistance;
  • Your application will be approved;
  • Your entire bill will be eliminated;
  • A specific reduction amount will be obtained;
  • Collection activity will stop; or
  • A decision will be made within a certain period.

Statements about reducing or eliminating medical bills describe possible outcomes and are not guarantees.

4. Fees and Payment

No upfront fee

There is no charge to submit an eligibility form or participate in an initial consultation.

Success-based fee

If FairBillUSA accepts your case, the success fee, method of calculating savings, payment timing, and other payment terms will be clearly stated in a separate written service agreement.

Unless the service agreement states otherwise, a fee is payable only when our services result in a confirmed reduction, waiver, forgiveness, adjustment, refund, or other approved financial benefit.

We will not charge a credit card, debit card, or bank account without your separate payment authorization.

5. Your Responsibilities

You agree to:

  • Provide accurate, complete, and truthful information;
  • Provide requested documents promptly;
  • Inform us if your circumstances or bill status change;
  • Review applications and documents before submission;
  • Respond promptly to requests from us or the hospital;
  • Avoid submitting false or altered documents; and
  • Continue monitoring bills, notices, deadlines, and collections.

You remain responsible for your medical bill unless and until the hospital or creditor confirms otherwise in writing.

6. Authorization to Act on Your Behalf

Some hospitals may require written authorization before they will communicate with FairBillUSA or allow us to submit documents for you.

You agree to complete reasonable authorization, consent, identity verification, or representative forms required for us to provide the requested services.

Any authorization is limited to the activities described in that authorization and your service agreement.

7. No Professional Advice

Information provided by FairBillUSA is for general informational and administrative assistance purposes only.

Nothing provided by FairBillUSA creates an attorney-client, healthcare-provider-patient, accountant-client, fiduciary, or other professional relationship.

You should consult an appropriately licensed professional regarding lawsuits, bankruptcy, taxes, insurance disputes, medical treatment, credit reporting, or debt collection rights.

8. Billing, Collections, and Credit Reporting

Applying for financial assistance does not necessarily stop billing, collection activity, lawsuits, interest, or credit reporting.

Unless a hospital or creditor confirms otherwise, you should assume that all deadlines and obligations remain in effect.

FairBillUSA is not a collection agency or credit repair organization. We do not promise to remove accurate information from credit reports, stop lawsuits, or alter the legal terms of a debt.

9. Privacy and Confidential Information

We may collect personal information needed to evaluate and manage your case, including contact details, household information, income documents, insurance information, hospital bills, and account records.

We may use or disclose this information as reasonably necessary to provide services, process your case, communicate with hospitals, operate our business, prevent fraud, and comply with the law.

Our handling of personal information is also governed by our Privacy Policy.

Although we use reasonable safeguards, no website, email system, transmission method, or storage system can be guaranteed to be completely secure.

10. Calls, Emails, and Text Messages

By providing your phone number or email address, you authorize FairBillUSA and its service providers to contact you regarding your inquiry, eligibility, application, case status, requested documents, and related services.

Communications may include calls, emails, and text messages. Message and data rates may apply.

You may opt out of marketing emails by using the unsubscribe link. You may opt out of marketing text messages by replying “STOP.”

11. Third-Party Services

Our website or services may use third-party platforms, including scheduling systems, electronic signature tools, payment processors, communication providers, analytics services, hospitals, and government or nonprofit resources.

FairBillUSA does not control the availability, security, policies, decisions, or operations of third parties.

12. Acceptable Use

You agree not to:

  • Use the website for unlawful or fraudulent purposes;
  • Impersonate another person;
  • Submit information without proper authorization;
  • Upload malware or harmful code;

14. Ending the Service Relationship

We may decline, suspend, or end services if:

  • You do not meet our case acceptance criteria;
  • You fail to provide requested information;
  • Documents appear false or misleading;
  • A legal restriction prevents us from continuing;
  • Continuing would be unlawful or impractical; or

15. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE, INFORMATION, FORMS, CONSULTATIONS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

FAIRBILLUSA DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, AND RESULTS.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAIRBILLUSA AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES.

FairBillUSA's total liability arising from a claim will not exceed the amount you paid to FairBillUSA for the services related to that claim during the six months before the event giving rise to the claim.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold FairBillUSA harmless from claims, losses, liabilities, and expenses arising from:

  • Your unlawful use of the website or services;
  • Your violation of these Terms;
  • False or unauthorized information you provide; or
  • Your infringement of another person's rights.
